1. ACCEPTANCE OF TERMS

Welcome to Campovida ("Campovida," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Campovida website located at campovida.com (the "Site"), including all content, functionality, and services offered on or through the Site.

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Site.

2. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Site after such modifications constitutes your acceptance of the updated Terms.

3. AGE RESTRICTIONS AND ALCOHOL PURCHASE REQUIREMENTS

3.1 Age Verification

You must be at least 21 years of age to purchase alcohol products from our Site. By placing an order for alcohol, you represent and warrant that you are at least 21 years old. We reserve the right to refuse service to anyone.

3.2 Legal Compliance

You agree to comply with all applicable laws regarding the purchase, possession, and consumption of alcoholic beverages. It is your responsibility to know and comply with the laws in your jurisdiction.

3.3 Delivery Requirements

An adult signature (21 years or older) is required upon delivery of all alcohol shipments. The recipient may be required to provide valid government-issued photo identification proving they are of legal drinking age.

4. USE OF THE SITE

4.1 Permitted Use

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
  • To impersonate or attempt to impersonate Campovida, a Campovida employee, another user, or any other person or entity
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site
  • To use any robot, spider, or other automatic device to access the Site for any purpose without our express written permission
4.2 Account Registration

To access certain features of the Site, including purchasing products or joining the Steward Association, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during the registration process
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

5. PRODUCT ORDERS AND PURCHASES

5.1 Product Information

We attempt to be as accurate as possible in describing our products. However, we do not warrant that product descriptions, images, or other content on the Site are accurate, complete, reliable, current, or error-free.

5.2 Pricing

All prices are subject to change without notice. We reserve the right to modify prices at any time prior to accepting an order. The price charged will be the price in effect at the time the order is placed, subject to our acceptance of the order.

5.3 Order Acceptance

Your receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to accept or decline your order for any reason at any time after receipt.

5.4 Payment

Payment must be made by credit card, debit card, or other accepted payment methods at the time of purchase. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

5.5 Shipping Restrictions

We can only ship to addresses where permitted by law. We reserve the right to refuse shipment to any location. Shipping availability and costs will be calculated at checkout.

5.6 Cancellations and Returns

Due to the nature of our products and alcohol shipping regulations, all sales are final unless the product is damaged or defective. If you receive damaged or defective products, please contact us at hello@campovida.com within 7 days of delivery.

6. STEWARD ASSOCIATION MEMBERSHIP

6.1 Membership Terms

By joining the Steward Association, you agree to the specific membership terms, including any minimum purchase requirements, allocation procedures, and member benefits as communicated to you during enrollment and as may be updated from time to time.

6.2 Membership Modifications

We reserve the right to modify membership benefits, pricing, and terms with reasonable notice to members. Members may cancel their membership in accordance with the cancellation policy provided at enrollment.

6.3 Member Obligations

Members are expected to maintain current payment information and fulfill any purchase commitments associated with their membership level.

7. TASTING ROOM RESERVATIONS AND EXPERIENCES

7.1 Reservations

Reservations for tastings and experiences at Campovida are subject to availability and may be made through our reservation system. We reserve the right to cancel or modify reservations due to unforeseen circumstances.

7.2 Cancellation Policy

Cancellation policies for experiences will be communicated at the time of booking. Late cancellations or no-shows may be subject to fees.

7.3 Conduct

All visitors to Campovida must conduct themselves in a respectful manner. We reserve the right to refuse service or ask anyone to leave the premises for disruptive, dangerous, or inappropriate behavior.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 Ownership

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Campovida, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Limited License

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not:

  • Modify copies of any materials from the Site
  • Use any illustrations, photographs, video or audio sequences, or graphics separately from accompanying text
  • Delete or alter any copyright, trademark, or other proprietary rights notices
  • Reproduce, distribute, or create derivative works from Site content without our express written permission
8.3 Trademarks

The Campovida name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Campovida or its affiliates or licensors. You may not use such marks without our prior written permission.

9. USER CONTRIBUTIONS

9.1 Reviews and Comments

The Site may contain features that allow you to post reviews, comments, or other content. By posting content, you grant Campovida a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, perform, display, distribute, and otherwise disclose such content.

9.2 Content Standards

You represent and warrant that your contributions:

  • Are accurate and not misleading
  • Do not violate any third-party rights
  • Do not contain defamatory, obscene, or offensive material
  • Do not promote illegal activity
  • Do not contain viruses or other harmful code
9.3 Monitoring and Removal

We have the right (but not the obligation) to monitor, edit, or remove any user contributions that we determine, in our sole discretion, violate these Terms or are otherwise objectionable.

10. PRIVACY AND DATA PROTECTION

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

11. PROHIBITED USES

You may not use the Site:

  • To attempt to gain unauthorized access to any portion of the Site or any other systems or networks connected to the Site

  • To use any automated system to access the Site in a manner that sends more requests than a human could reasonably produce
  • To introduce any viruses, Trojan horses, worms, logic bombs, or other harmful material
  • To harvest or collect information about Site users without their consent

12. THIRD-PARTY LINKS AND SERVICES

The Site may contain links to third-party websites or services (including payment processors, reservation systems, and social media platforms) that are not owned or controlled by Campovida. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

13. DISCLAIMER OF WARRANTIES

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CAMPOVIDA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CAMPOVIDA DOES NOT WARRANT THAT:

  • The Site will function uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Site or servers are free of viruses or harmful components
  • The results of using the Site will meet your requirements

14. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CAMPOVIDA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Site
  • Any conduct or content of any third party on the Site
  • Any content obtained from the Site
  • Unauthorized access, use, or alteration of your transmissions or content

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID CAMPOVIDA IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

15. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Campovida, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Site
  • Your violation of any rights of another
  • Your violation of any applicable laws or regulations
  • Any content you submit or transmit through the Site

16. DISPUTE RESOLUTION

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

16.2 Venue

Any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the federal or state courts located in Mendocino County, California, and you consent to the personal jurisdiction of such courts.

16.3 Informal Resolution

Before filing a claim, you agree to contact us at hello@campovida.com to attempt to resolve the dispute informally.

17. CALIFORNIA RESIDENTS

If you are a California resident, you may have certain rights regarding your personal information under the California Consumer Privacy Act (CCPA) and other California laws. Please see our Privacy Policy for more information.

18. FORCE MAJEURE

Campovida shall not be liable for any failure to perform its obligations under these Terms where such failure results from any cause beyond our reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation, natural disasters, acts of God, war, terrorism, riots, or governmental actions.

19. WAIVER AND SEVERABILITY

19.1 Waiver

No waiver by Campovida of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

19.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

20. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and Campovida regarding your use of the Site and supersede all prior agreements and understandings.
